as Sunsnapper says, ICANN deal with these types of complaint in conjunction with WIPO..
this basically is setup to protect companies etc.. the basics of it are, if someone registers a domain name of a well known organisation solely for the gain and profit of selling that domain to the company the name belongs to, then it is deemed inappropriate and the domain can be forced to be released by the registering name server company etc.
xoops i believe has good grounds for this whether the name is trademarked or not simply because it is a worldwide company ( i say company as an example)
i say protected already, because a simple search on the name XOOPS does not give any other businesses using that name other than for XOOPS CMS and e-Xoops. therefore you have grounds for seeking arbitration under this international agreement.
the company that registered this name is exactly doing this for profit to sell back to xoops. i noticed they have also registered postnuke.fr, winamp.fr and a lot more..
they should not be allowed to get away with this.. but unfortunately as stated above, XOOPS community doesn't have the resources or funds to pursue such an action.. as in all these cases it's the complainant who has to pay the bill and compensation can't be awarded whether the complainant wins or loses..
but i would think winamp will have the necessary funding if thewy want to contest it.
