To whom it may concern,

This is an official notice and request to remove the xAsset module from Xoops.org module repository (https://xoops.org/modules/repository/singlefile.php?cid=22&lid=1485).

Please note that xAsset is no longer available for general use and is no longer released under the GPL.

Please note that any site hosting the xAsset module for download will be in violation of my copyright.

Regards.

Why don't you develop a new version of this module and leave the current free as is so people can enjoy using it and maybe buy the new version from you?
Be smart, stay smart. Stay one step ahead...

The licence that accompanied those modules were GPL.

Note the first one I quote:

Quote:
Can the developer of a program who distributed it under the GPL later license it to another party for exclusive use?
No, because the public already has the right to use the program under the GPL, and this right cannot be withdrawn.

Quote:
Does the GPL allow me to require that anyone who receives the software must pay me a fee and/or notify me?
No. In fact, a requirement like that would make the program non-free. If people have to pay when they get a copy of a program, or if they have to notify anyone in particular, then the program is not free. See the definition of free software.

The GPL is a free software license, and therefore it permits people to use and even redistribute the software without being required to pay anyone a fee for doing so.

Quote:
Does the GPL allow me to distribute copies under a nondisclosure agreement?
No. The GPL says that anyone who receives a copy from you has the right to redistribute copies, modified or not.

Quote:
Is the developer of a GPL-covered program bound by the GPL? Could the developer's actions ever be a violation of the GPL?
Strictly speaking, the GPL is a license from the developer for others to use, distribute and change the program. The developer itself is not bound by it, so no matter what the developer does, this is not a "violation" of the GPL.

However, if the developer does something that would violate the GPL if done by someone else, the developer will surely lose moral standing in the community.

Quote:
Do I have "fair use" rights in using the source code of a GPL-covered program?
Yes, you do. "Fair use" is use that is allowed without any special permission. Since you don't need the developers' permission for such use, you can do it regardless of what the developers said about it--in the license or elsewhere, whether that license be the GNU GPL or any other free software license.

Note, however, that there is no world-wide principle of fair use; what kinds of use are considered "fair" varies from country to country.

I agree with Tom. The original module was released under GPL and is still governed by GPL. The developer may wish to go on and turn the application into a commercial product with a different licence, but the original module is still GPL.

When software is created under GPL, the developers benefit from FREE user testing, FREE feedback and FREE bug reports, often from experienced coders. This is extremely costly for commercial software companies.

I respect McNaz wishing to move on, but IMHO it is highly improper to take advantage of the resources offered by Xoops.org and then attempt to withdraw a module.
A thread is for life. Not just for Christmas.

Re: Official Notice for removal of xAsset from the Module Repository

According to the GPL licence the developer of a GPL product cannot withdraw the product once distributed.

This automatically means that copyrights are not violated if this module is in use on any website or if the module is distributed.

A developer can only withdraw his support for the module.

The GPL open source license states that the copyright holder grants any and all users the non-revocable, everlasting right to use the released code as they see fit, as long as the users apply these terms to the same code and its derivative works.

So, does anyone have a copy of the modules? *I* for one think they're very good, and think that MacNaz has done XOOPS a great service by releasing them, whatever his feelings towards XOOPS.org may be now. I thank him for releasing his code too, and will always credit him for his work.

But the modules are out there, and they're here to stay. Notice or no notice, but this clearly isn't a violation of copyrights. If you disagree, take the XOOPS Foundation to court over this, and lets find out who is right (this is not a threat, nor a call for 'civil unrest', but a proposal to get this settled one way or another).
