if you can try to contact the origina theme designer, and tell him that you use his header or his theme and transformed it to a XOOPS theme, and if it was a template and transformed to php nuke so contact to template designer.
you did a nice theme but it's better to let the designer knows

The header is designed by mtechnik. but that domain is no longer available but the place i downloaded the header i sent them an email
