its a shame there is some sort of advisory board with a lawyer on it who could advise in this situation... but i guess that was all just more of mambas smoke in mirrors...

Don't worry, Will, we're getting advise, and we'll be acting on it...

The intent of the original owner was NOT to sell/give it to Herko so he could make money. The intent was to give it to XOOPS, and Herko accepted it on behalf of XOOPS, therefore he cannot legally sell it, as it belongs to XOOPS and not to him.

Being that the case 500 Euros wil not pay the respect/consideration he will/is loosing.
Does not matter how this story will end for Herko and Xoops. It is already a sad one.

I do agree guys. We all know this was coming... it was only a matter of time.
Really, it is just bringing more sht and we have SOOOOOO better things to do!
They are slowly dying.... leave them at it. We are doing great, let's continue and focus on that !

Please guys do not comment on the XOOPS forums, especially regarding the

I believe I know who the naughty boy was! lol

Seriously though we need to move on and not lower ourselves to these
standards. We're better than this and we're doing real good now so
please lets not have any set backs. Just ignore them and keep on moving.
We don't need to defend ourselves, look at their web who's on-line it's
now constantly below 100 most times I look it's lower than 50 but it
used to be 100's, so we don't need to be dragged down with them.

I've sent this to both lists as it affects everyone even though it
shouldn't! I don't need a reply to this, lets just move on.....

I agree...there is no more reason to comment on this... this will probably happen: Herko will sell the domain to some perhaps unfortunate buyer... then XOOPS will claim the domain as part of ICANN's trademark policy... The new owner will feel cheated by Herko and hopefully he's a Hells Angel

[EDITED by the moderator as it had nothing to do with XOOPS and was a personal attack]

Please, look some details here:
http://www.linkedin.com/in/herko

And his self-description as chairman of xoops.org:

# The XOOPS Foundation: Founder, chairman

November 2004 — Present (3 years 10 months)

The XOOPS Foundation is a Dutch foundation (Stichting) created to support the XOOPS open source content management system project and it's international community of users and participators.

My tasks:
- asset management, mainly managing the funds generated from ads and donations, the webservers the project is hosted on (owned by the Foundation) and the trademark rights to the XOOPS name.
- organization development, creation and implementation and leading the project organization. Was not a big success, due to many reasons.
- leadership development, encouraging people from the community to become leaders within the open source movement.
- legal issues such as filing police reports against hackers who destroy the XOOPS project knowingly and purposefully, as well as getting companies that infringe on the XOOPS project copyrights to cease and desist.
- fund raising for the project.
- administrative management
- representation of the project to businesses and organisations.

An idea from another topic: "Herko owns xoops.com and xoops.nl; If Herko is selling xoops.com, the domain xoops.nl cannot be a official XOOPS support site." Logic? What do you think about it?

I think you are missing the point my friend - XOOPS never owned xoops.com

There is nothing unlawful about what is going on, if XOOPS Council wants the domain so badly - buy it. Maybe I will buy it and donate it to XOOPS Cube.

Maybe I donate to Mikhail. Are you interested in owning xoops.com Mikhail - I buy for you. ;-D

@ Moderators: the accounts 21Monkeys, Hecoo, herko-c and herko_c are being used by the real Herko Coomans again.

@ Herko Coomans: tell us what is your point of view using your real account please.

If Herko buys a domain on behalf of XOOPS, then XOOPS owns it. XOOPS just needs to reimburse him. If he is selling the domain that he bought on behalf of XOOPS in his official capacity as XOOPS Project Manager, then he is committing a fraud. Plain and simple.

But my understanding was that the domain has been donated to XOOPS and transferred to Herko, so he didn't purchase it. If he did, I would love to see an invoice.

But why should we argue about it?

We all know that ethically/morally it's totally wrong! Legally? We'll let the lawyers and ICANN figure that out.
