Change your virtual path to:

'http//:xxxxxxxxxx.xxx/~xxxxxxx'

OK

Turns out i am stupid

define('XOOPS_URL', 'http//:mydomain.com/patsy');

the url was invalid due to the "http//: " bit being miss typed.

that should have been
define('XOOPS_URL', 'http://mydomain.com/patsy');

Im now off to shoot my other foot
