James is correct. Use of the XOOPS logo is allowed as long as it is used to positively promote XOOPS. If you can make money doing that, that's also good.

If I'm reading the license correctly, they are using the logo within the legal limits.

As far as their site not being a XOOPS powered site.... Well, this this just my personal oppinion, but are we going to tell every webmaster who wants to promote XOOPS or offer XOOPS services that they have to use a XOOPS powered site? I hope not.

I think the XOOPS logo needs to be removed from the site. This is copywrite by the XOOPS foundation and not to be used for personal gain.
