Don't you love Open source?

Some bloke spends hours creating unique graphics that eventually go in a theme which helps makes ends meet and then here comes another one who takes bits from here and bits from there and creates atrocious things who get published as news on x.org

Is one thing to be inspired and another to take someone elses work, painted differently and say Hey I can do themes me!.

Is it that bloody hard to understand that it is NOT ok to take bits from a commercial items and distribute them free!?

Is this still the same case?

I know that in the past he modified a theme and gave himself credit for it, and that he used Erol's graphics in his theme. And if I remember correctly, he was told that this was not OK.

Does the new theme contain graphics that are "proprietary" or the theme doesn't contain the required credits?

And how you did the body image ... or well you get the idea!
I can go on really but whats the point.

There are a lot of things people don't know about me cause am as proud as everyone else (if not prouder) and there are some things that most of you don't know about me, like the fact i live in a small office cause i struggle to raise money to rent a stupid flat, or that are months when i struggle to have food money cause i keep the theme site up at all costs, there's good months too to be fair but their very far appart

And then there's people like this who make it even harder.

But that's oky, why should we pay for one's hard work when others will duplicate it and distribute it free right?

Has been hard disclosing very personal things, but hey if this is the price to pay for opening at least 1 person's eyes about how stealing one's work can affect the person you steal from then it was all worth it!

I urgently request removal of this post and banning of this user, and I'll say why:

* He is stealing things from others from commercial themes, without even asking it and without permission.
* He steals and does not give at least credit
* Promoting a piracy/warez site in a previous comment in this post!

In my eyes, the only proper treatment to this guy and all thieves (because this is theft) is banning.
Stealing, pirating and leeching are some things that are not to be allowed in any case.
I, myself, have changed themes released by Burning (creating the themes lagoon and phoenix), but I gave full credit to him - and the theme in question was not commercial.

Aphex, you are fully right. I fully respect you and it's clear that he has stolen several images from you for that theme. And I find it unacceptable.

Let's give Heyula a chance to respond.

If his new theme contains elements that have been taken from commercial themes/sites, or have been taken from Open Source themes without giving credit were credit was due, we definitely will remove this news and ban Heyula.

I know that there was a problem in the past. We wanted to give Heyula the benefit of the doubt, because sometimes people don't really understand Open Source licenses. Heyula was made aware of that.

If he still continues with the same behavior then we would have to ban him.

But if he learned from it and doesn't do it anymore, then it's a different story.

So who downloaded the new theme and can confirm that parts of it are taken from other themes without giving proper credit?

Erol, does the last post from Heyula make sense? Please note: right now we're talking only about the new theme.

And the background, Heyula? Can you confirm us where you got it or how you created this?

For the rest, that photoshop image doesn't seem very convincing, except for the footer. Gaussian blur just makes things a bit blurry, vague.

And Heyula - I don't say that you stole everything - I just say it's obvious that you at least stole/used the background.
Some little proofs about stealing the bg:
* They are exactly the same size; 1280 x 730
* Both jpg (doesn't say that much)
* And even the same size!!! 35,41 KB !!! (this says enough).

Is that enough proof, Mamba?

And mamba, delete this comment of Heyula:

And another proof: I copied both backgrounds and put them on top of each other - Heyula's bg below, and Aphex's bg on top, with 50% opacity. Guess what? No difference...

I'd like you all to see it, but I won't share the PSD. I expect copyright and the maker ;)

And you don't have to tell me? Which program did you use for what, as with Fireworks alone I don't know much.

Secondly, I'm not calling you a thief if you aren't. If you are not, and you can prove it, I'll take my words back, but for now, it seems very strange.

Several parts from your theme are indeed from different sites, as you've said before, but do you have permission of those site owners? You can't get something from the internet and do whatever you want with it. To say it with the words of Google Image Search: Quote:

Image may be subject to copyright.


When you use things without permission, you're stealing. And since we can't download the theme anymore, we can't check if you gave credit - but you still need permission.

And if you don't care about pending deletion of something, why do you make it in the first place? Every theme should be something you're proud of and you'd like to share with others.

And indeed, you've made a free theme, and you have shared it, but I can make a lot of free themes in that way too. Licenses are there for something.

Now, it's your turn. Please prove us that you are only using original graphics or graphics where you have permission for and prove that you give credit for the owner. And please avoid posting links to warez sites on XOOPS, as you have broken the XOOPSiquette, to know this rule:

And here is what normally happens when you break those:

Heyula,

If Aphex confirms that you had a permission to use his graphics, then it's a different story. But if not, and based on his earlier comments that's the situation here, you're in violation of his copyright.

For example:

1) The background:
His: https://www.aphexthemes.com/demoz/xoops/themes/APH007/visual/bgermainbg.jpg
Yours: http://vuslat.info/themes/heyula-xtr-7/img/background.jpg

2) Another background:
His: https://www.aphexthemes.com/themes/newphex/visual/headorn.png
Yours: http://ahsapkapici.com/themes/ahsap/images/top1.png

This is not right! The least what we can expect from each other is to honor and respect each other's copyrights.

Therefore please apologize to Aphex and remove within a week all his non-Open Source images from all your themes and websites, and use it as a learning experience about copyright issues, so it won't happen again.

If you won't do it within a week, we'll have to ban you from XOOPS Website.

We are very serious about copyright violations and will not tolerate them here.

I truly hope that you fix this situation and learn from this experience for the future.

Heyula says I agree... I didn't agree to anything, however he told me he'll remove the theme from download and I told him that he doesn't have to because let's face it..once you put a thing on the internet it won't ever be deleted.
Its enough for one person to make a download and from there it spreads, and giving the huuuge number of sites syndicating xoops.org you can imagine how fast the news circled the globe!

That is not how those images were created and you know that, but I'll give you credit for learning new things in a relatively short time to try and prove something. I showed you on our msn chat few more images one of which was created by merging 3 images.

I haven't invented shapes or effects or brushes or any other tool used in CS so I can't take credit for that, but I can take credit of a finished product which wasn't even reverse engineered..it had pieces removed and used in a similar product.

There is nothing wrong in porting, but it is when you don't have written consent of the original creator which in the case of commercial items I very much doubt one will get.

To come to an end (again), there were very rare cases when someone asked for sources of images and I said NO. I don't get what is so hard to ask before ? Is not like the world will end if you receive a negative answer!

All that's left to do is finally release a thing for free simply cause I'm forced to, its not fair for me to have to do that...and its definitely not fair to those who previously purchased the item or purchased the membership needed to gain access to that item.

Just background picture of this theme is belong to apex. I do everything leftover of this theme. When i use this background picture, i wanna permission from apex. When he dont give permission me, i delete this theme. I dont rob anything. I do a free theme and i share this. And now you can do everything of you want. If you wanna delete this title.

Heyula, I understand that you try to do good - but you have to ask permission before you release it.

That's like making a "The Simpsons" game and release it but you still need to ask permission. That'll result in a lawsuit quickly ;).

As about asking permission, try to ask it before you start working on a theme or while you are working on it.

My total support to aphex and all graphics designers. I'd hope I can have one percent of your creativity.
Also I am not very comfortable about aphex words cause, in my understanding, you are saying that we, xoops community, support piracy and that's not correct.

heyula,
it's better to be inspired by aph3x's themes, he's one of the best XOOPS theme designers,but never use anything without permissions, try always to do your best to be different and to be yourself, and remember always that Knowledge is a cumulative process,it means not necessary our first theme must be a very professional one like Aphex's one but by learning more codes we can make a big progress.

it's the third time that I notice that you take an existing theme , you do some changes and you say it's yours , the first time you took a theme for bleekk, from few weeks you did a version from maitsco classic without emailing me to use the same title of my theme, and now there is a new problem. Unfortunatly to hear this, but you still have the chance

We wanted to give Heyula the benefit of the doubt, because sometimes people don't really understand Open Source licenses.

Profit well from this opportunity and be yourself, create your own style, and sure you will find lot of XOOPSERS appreciating your work and use your themes.
