Actually, I love the road you have taken from your inspiration of the Gamespot theme and look forward to making use of them as you produce them. Excellent work all around IMHO.
Seriously, just because your Gamespot Theme was produced to mimic it's predecessor doesn't mean that it "is" a Gamespot clone. They (Gamespot) are famous for changing their layout, and yours is just a variation on that theme which only resembles part of the whole. Theirs is much more sophisticated and I see no infringement. You were merely inspired. Great creativity spawns from inspiration in many different areas of life as a whole and I applaud your work!

I certainly wouldn't feel any pangs of guilt and my space site needs a darker feel. I jusst happen to like the colors and overall design of this wonderfull theme!
