You should have mentioned in the readme.txt or in comments in the theme.html that it was based on obscene_v3
However, from a GPL point of view there is not really any violation since the original obscene_v3 does not contain any credits in neither readme file nor theme code comments (under the GPL you are not required to keep visible credits as long as you keep the hidden/commented credits)
Images, however, are protected by implicit copyright by the creator and permission to use them should be allowed explicitly by him/her
So I encourage every theme and module writer to include credits in commented code and/or readme files.
@SamiK: All you had to do was say that the theme was based on obscene_v3 from Aston themes and noone could point fingers at you. Please keep this in mind in the future.

As you can read in the disclaimer (readme.txt included in the theme) of this theme i say this theme is an aston theme that i have modified. I'm sorry i have not specified it but it's clear in the description of this theme on my site (in italian).
I'll translate the description in english for more clearence.

Re: SamikLand Themeit is nice that you have noted it is based on an aston theme in your readme and your site, but as noted above, nothing has changed other than you have added an image switcher for header.
this should be added to XOOPS FAQ (How can I display different images or include different stylesheets according to the currently viewed module?) and not as a new theme in Themes Library.

RandomizerI use a randomizer http://www.alistapart.com/articles/randomizer/ for the header image on one of my sites. (http://misguidedthoughts.com.) EDIT: I no longer use this randomizer Not only can it give you a header, buy you can randomize other images in other places. I saw one site that had five seperate images called to make a collage of family, randomly, in the header.

While it is good to be on top of things, I doubt if anyone who intended a real infringement would have posted it back here. I felt a little like there was an undeserved harsh attitude maybe ...
If anyone wants to really catch theme copyright infringers, they could go to obscure CMS sites and look for "additions to the themes library" someone is using to build their reputation with the ignorant isolated people on that site. I know of at least one with XOOPS themes buried in repositories with other names etc.
I just wanted to pitch a little reality check for anyone who got upset by this at all ... seems like an honest mis-step, not a case for the "cop in a donut shop" exaggeration ...
