I'm fairy new to Xoops, but I thought leaving their copyright intact was part of the terms of use. I am mistaken about this? Is this some perk of being a donor to XOOPS or something?

You have 100% freedom to use XOOPS to whatever you want.

What has been removed, and is a violation of the license agreement, unless approval has been given by the designer, is that the statment regarding who had designed the theme (7dana.com):
